Success rates at appeal are usually 60-70%. This doesn’t include all the decisions changed at the mandatory reconsideration stage, or after you ask for an appeal but before the hearing. 

You are also more likely to win if you take part in the hearing (these statistics above include all the appeals decided on the papers alone). So if you think the decision is wrong seem to have a case, it is definitely worth trying. Make sure you:

  1. Use our free WCA mandatory reconsideration tool to set out your case if you have not yet completed the mandatory reconsideration stage.
  2. Follow our advice on how to ask for and how to prepare for your appeal
  3. Always take part in the hearing. You can make it less stressful by using our free tool to write a tribunal submission which sets out why the decision should be changed, and giving it to the tribunal in advance.
