Unfortunately, there are no time limits on how long a mandatory reconsideration can take.
We suggest that if you have not heard back after 8 weeks, you should ring them and find out what is happening. Keep a note of the phone call – date, time and who you spoke to in case you need to call again.
If you have not heard after 12 weeks, you could make a complaint for the unreasonable delay. See Challenging a work capability assessment decision for our advice on how to write an effective complaint.
Don’t worry - You will not be punished for having made a complaint, it will be looked at separately from your mandatory reconsideration.
